1. ENROLMENT

Upon payment of the annual non-refundable enrolment fee, a student’s place is reserved in their chosen classes and they are considered enrolled for the current calendar year. This fee covers insurance, music licensing and admin costs.

2. CANCELLING ENROLMENT

a. School-Age Students – withdrawal and cancellations 

School Age-Students are enrolled on an on-going basis for the full dance year. Families wishing to withdraw at the end of a term, must provide written notice (2) weeks prior to the commencement of the following term.

No refunds, credits of fee reductions will be provided for withdrawal during a term. 

An exception will be made where a family permanently relocates more than 20 kilometres from the Studio and provides at least four (4) weeks’ written notice. In such cases, fees will only be payable up to the student’s final attendance date.

b. Preschool Dancers – withdrawal and cancellations 

Students enrolled in Toddler Creative Dance and Kinder Creative Ballet may withdraw during a term by providing a minimum of two (2) weeks’ written notice.

If wishing to withdraw at the end of a term, (2) week’s written notice is required.

All students are required to re-enrol for the commencement of each new calendar year.

3. FEES

Fees are due by the first Saturday of each term. Please refer to the due date shown on your invoice.

For larger invoices, fees may be paid in two instalments. The first instalment must be received by the due date and the second instalment one month later.

If you are unable to pay fees within the required timeframe, please contact us to discuss a payment arrangement.

If fees remain unpaid for more than thirty (30) days after the invoice due date, Balance Dance School reserves the right to suspend the student’s participation in classes, performances and examinations until the account is brought up to date and may commence debt recovery proceedings.

4. MISSED CLASSES

No refunds, credits or fee reductions will be provided for classes missed due to illness, injury, holidays, school commitments, family commitments or other personal circumstances.

Make-up classes may be offered at the Balance Dance School’s discretion, subject to availability and suitability.

Make-up classes have no cash value, cannot be transferred between students and cannot be redeemed for refunds or credits.

If a class is cancelled by Balance Dance School due to teacher illness, venue issues or other unforeseen circumstances, Balance Dance School may provide a substitute class, replacement teacher, make-up lesson, online lesson or other reasonable alternative

5. COMMUCIATION

It is the parent’s responsibility to read relevant newsletters, information and updates issued via email or text via the email and phone number provided on enrolment and to notify us of any changes to contact details. 

6. WATCHING CLASS 

We welcome parents and carers into the studio to watch Kinder Creative Ballet & Toddler Creative Dance on the chairs provided at the back of the studio. Please limit this to a maximum of two people per dancer.

Please ensure that you are quiet while the class is in progress – any noise is a distraction to both little dancer and teacher. Recording from mobile/multimedia devices or any photography is strictly prohibited.

For all school aged classes, Parents may watch at the special invited ‘parents watching day’ during the year – all other classes are closed to viewing.

7. CHILD COLLECTION and Emergency contact details

Parents/carers are responsible for ensuring their child is collected promptly at the conclusion of each class, rehearsal, performance, or other studio activity.

Parents/carers must provide current and accurate contact information and at least one emergency contact.  Balance Dance School will rely on the information provided and accepts no responsibility for any consequences arising from inaccurate, incomplete, or outdated information.

If a student has not been collected within a reasonable period following the scheduled end time, Balance Dance School staff will attempt to contact the parent/carer and/or nominated emergency contacts using the details provided.

Where a child is collected late, Balance Dance School reserves the right to charge a late collection fee to cover the costs of additional supervision and staffing. Any such fee will be payable by the parent/carer responsible for the enrolment. 

If Balance Dance School is unable to contact the parent/carer or nominated emergency contacts, or if there are concerns for the child’s safety or welfare, Balance Dance School reserves the right to take such action as it considers reasonably necessary in the circumstances, including contacting relevant authorities or emergency services where appropriate.

By enrolling a child in classes, parents/carers acknowledge and accept their responsibilities under this clause.

8. PHYSICAL CONTACT

Parents are advised that some physical contact may be necessary by a teacher to demonstrate exercises or techniques, or if a staff member needs to administer first aid.

9. WORKING WITH CHILDREN

The Principal and all teachers of Balance Dance School have a Blue Card as required by Commission for Children and Young People and Child Guardian.

10. MEDIA CONSENT

Students may be photographed or filmed for promotional, educational and marketing purposes, including use on the Balance Dance School website, social media platforms and printed materials.

Permission will be sought from parents/carers prior to publication of identifiable images.

No payment or compensation will be provided for the use of such images or recordings.

Please note that photography and recording by parents, carers and visitors during classes is strictly prohibited.

11. CLASS NUMBERS

If enrolment numbers fall below the viable number (approx 4-5) Balance Dance School reserves the right to cancel, shorten or transfer the class – fees paid will be credited pro rata.

12. UNIFORM

There is no set uniform for students enrolled in Toddler Creative Dance and Kinder Creative Ballet classes (please wear suitable attire suggested on our uniform page). All other students must adhere to the BDS uniform regulations, be suitably groomed and be ready for class 5 minutes before the scheduled class time.

13. FIRST AID

A stocked first aid kit is accessible to all classes at all times. In the event of a medical emergency, if parents are unreachable, it is understood that the teacher reserves the right to call for an ambulance service.

13. NATURAL DISASTERS AND UNFORESEEN EVENTS 

Balance Dance School is committed to providing high-quality dance instruction. In the event of natural disasters, extreme weather, public health events, government-mandated closures or other circumstances beyond the Studio’s reasonable control, classes may be cancelled, rescheduled, delivered online or otherwise modified.

No refunds, credits or transfers will be provided except where required under Australian Consumer Law. Where practical, a make-up class or alternative arrangement may be offered at the Studio’s discretion.

14. CHANGES TO TERMS AND CONDITIONS OF ENROLMENTS

Balance Dance School reserves the right to amend, update or replace these Terms and Conditions from time to time where reasonably necessary for the operation , safety, administration, or legal compliance of the studio.

Updated Terms and Conditions will become effective upon publication on the Balance Dance School website. Continued enrolment and participation in Balance Dance School activities constitutes acceptance of any amended Terms and Conditions.

15. AUSTRALIAN CONSUMER LAW

Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law or any other applicable legislation.
